Please read this Terms of Service ("Terms," "Terms of Service") carefully before using the neheliskiing.com website (the "Website") operated by True North Heli-Skiing Ltd. d/b/a Northern Escape Heli-Skiing, a(n) Limited Company formed in British Columbia, Canada ("us," "we," "our") as this Terms of Service contains important information regarding limitations of our liability. Your access to and use of this Website is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone, including but not limited to visitors, users and others, who wish to access and use the Website.

By accessing or using the Website, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have our permission to access or use the Website.

Prohibited uses

You agree that you will use this Website in accordance with all applicable laws, rules, regulations and these Terms at all times. The following is a non-exhaustive list of prohibited uses of this Website. You agree that you will not perform any of the following prohibited uses:

  1. Impersonating or attempting to impersonate True North Heli-Skiing Ltd. d/b/a Northern Escape Heli-Skiing or its employees, representatives, subsidiaries or divisions;
  2. Misrepresenting your identity or affiliation with any person or entity;
  3. Sending or attempting to send any advertising or promotional material, including but not limited to spam, junk mail, chain mail or any similar material;
  4. Engaging in any conduct that restricts or inhibits any person’s use or enjoyment of the Website, or which, as determined in our sole discretion, may harm us or the users of this Website or expose us or other users to liability;
  5. Using the Website in any manner that could disable, overburden, damage or impair the Website or interfere with another party’s use of the Website;
  6. Using any robot, spider or other similar automatic technology, process or means to access or use the Website for any purpose, including monitoring or copying any of the material on this Website;
  7. Using any manual process or means to monitor or copy any of the material on this Website or for any other unauthorized purpose;
  8. Using any device, software, means or routine that interferes with the proper working of the Website, including but not limited to viruses, trojan horses, worms, logic bombs or other such materials;

Governing law, severability, dispute resolution and venue

These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of laws provisions. These terms shall not be governed by the United Nations convention on contracts for the sale of international goods, the Uniform Commercial Code, nor Incoterms.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and us regarding our Website, and supersede and replace any prior agreements we might have had with you regarding the Website.

Any controversy or claim arising out of or relating to these Terms including but not limited to the interpretation or breach thereof shall be resolved in a court of competent jurisdiction in British Columbia, Canada.

Changes to Terms of Service

We reserve the right to make changes to these Terms of Service at any time. We will notify you immediately of making any changes to these Terms of Service via by posting the updated terms of service to this website.

Language

Booking Terms and Conditions

Terms and Conditions Agreement. Please read these Booking Terms & Conditions (T&Cs) carefully. These T&Cs in their entirety constitute a legally binding agreement between you and True North Heli-Skiing Ltd., dba Northern Escape Heli-Skiing. By making a booking with Northern Escape Heli-Skiing (referred to as NEHS, us, our, we or similar in these T&Cs), you are agreeing, on behalf of yourself and all other individuals that you book for, to be bound by these T&Cs. You further agree you are acting as an agent for such individuals, and these T&Cs apply to them, and it is your responsibility to bring these to their attention. 

T&Cs Binding on Non-Booking Guests. By agreeing to participate in a booking with NEHS, you agree to be bound by these T&Cs.  If you do not agree to be bound by these T&Cs, do not proceed with participating in the booking.

  1. Release of Liability (Waiver) Required

    All guests are required to read and agree to our current* Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement (the “Release of Liability”) as a condition of participating in any booking with us. If the Release of Liability is not completed, the individual will not be permitted to participate. By agreeing to the Release of Liability, you waive or give up legal rights to sue or claim compensation following an accident. The sample of our Release of Liability can be reviewed here – Release of Liability (Waiver) PLEASE READ IT CAREFULLY!

    The Release of Liability will apply for 24 months from the date you sign it. Each adult must complete their own and a parent/legal guardian must complete it for anyone under 19. If you are booking for others, it is your responsibility to inform them of this requirement and the terms of the Release of Liability. *NEHS reserves the right to update its Release of Liability. Guests will sign the most current version at the time of signing.

  2.  Acknowledgment and Acceptance of Risk.

    1. Heli-skiing involves risks, dangers, and hazards, including avalanches. All guests must be aware of and willingly assume the risks, dangers and hazards associated with participating. For a list of risks, dangers and hazards, review the Release of Liability (Waiver). By participating, you agree you are aware of and fully and voluntarily assume these risks, dangers and hazards, including the risk of avalanche. You are responsible for maintaining the necessary physical fitness and skills required to participate in the trip. You will stay alert to risks, dangers and hazards, act prudently throughout the trip, and bring any concerns to our attention immediately.

    2. You agree to participate in all NEHS safety briefings including, but not limited to, Avalanche Rescue Practice, Helicopter Safety Briefing and the daily Morning Briefing, prior to participating in the ski program.

    3. You agree to use the Avalanche Safety Equipment provided by NEHS and as demonstrated by the NEHS ski guides. 

  3. Registration, Deposit and Payment

    1. All Pricing is in Canadian Dollars (CND)

    2. Northern Escape Heli Skiing utilizes a payment App, Flywire, for all payments.

      1. Payments made directly to Northern Escape Heli Skiing, outside the Flywire app, are subject to a 5% service charge.

    3. The initial Deposit is equal to 20% of the total trip cost and is due within 10 days of receipt of the Booking Confirmation. All Deposits are Non-Refundable. 

    4. Final Payment is due and payable 120 days prior to the trip commencement. Final Payments are Non-Refundable. For bookings made less than 120 days prior to the package commencement, the full package price is due at time of booking.

      1. Reservations may be cancelled without notice to the guest if full payment has not been received by NEHS on the due date. In this case no refund is given. 

    5. Northern Escape Heli-Skiing reserves the right to amend prices and/or polices without notice prior to a booking being confirmed.

  4. Travel

    1. It is your responsibility to arrive on time as noted in the Booking Confirmation for each NEHS package. You are responsible for any extra costs incurred if arriving late for any reason including, but not limited to, flight delays and cancellations.

    2. It is your responsibility to ensure proper entry through Canadian Customs. No refunds will be provided in cases where entry to Canada is denied. 

  5. Cancellation and Replacement Policies.

    1. Cancellation Notification. If you wish to cancel a booking, please notify NEHS in writing by contacting our office; reservations@neheliskiing.com.

      1. Insured Bookings. NEHS will provide your insurance company with all details needed to make a claim.

      2. Non-Refundable Initial Deposit. Initial Deposits are non-refundable 48 hours after the payment of the Initial Deposit is made. You must provide written notice of cancellation of your booking to us within this initial 48-hour period to cancel and receive a refund.

      3. Non-Refundable Final Payment. Final payments are non-refundable after the Final Payment Date.

      4. All Bookings are subject to cancellations if payments are not received on time. In this case all payments are Non-Refundable. 

    2. Replacement. Guests are not permitted to sell their booking directly to another guest.

      1. You may nominate in writing an appropriate replacement for your booking. For safety reasons, an appropriate replacement guest is subject to the new guest’s skiing/boarding ability being appropriate to the trip and NEHS reserves the right to refuse the referred replacement on this basis, in which case the guest may find another appropriate replacement. If you replace yourself with an accepted new guest, the new guest will be required to complete a new booking with applicable payment received and the T&Cs and Release of Liability agreed to. A $250 admin fee will be applied to the booking.

      2. NEHS has no responsibility nor provides assurances to find a replacement on your behalf. However, if NEHS is able to confirm a replacement, then you will receive a full refund less a $250 administration fee after the new booking is completed.

    3. Date Change. A guest may opt to change their booking to a different available date in the same heli-skiing season. Changing dates is subject to an administration fee of $250. 

    4. Cancellation Mid-Trip. All packages are sold in units beginning and ending on a specific date. No refund is given, in whole or in part, for un-used days due to late arrival or early departure. In addition, no refund is given for any unused portion of your package due to poor physical fitness, skiing/boarding ability, illness or injury. There is no refund if you choose not to participate in any activity or to return to the lodge early.

    5. NEHS makes Cancellation. NEHS reserves the right to cancel bookings for whatever reason NEHS deems necessary. In such a case, NEHS will refund or credit to the account, as per the guest’s preference, the total payments made to NEHS by the guest to that date for any unused portion of their trip. NEHS will not be responsible for any other travel, interruption or additional costs or lost opportunities, including without limitation, cancellation fees, airfare, third-party accommodations, meals, rental charges, services charges, lost deposits or payments, or for any direct, indirect, consequential, liquidated, compensatory, or incidental damages or any other damages or amounts of any nature whatsoever.

  6. Cancellation/Interruption/Medical Travel Insurance.

    1. NEHS highly recommends you arrange for appropriate insurance for their travel. Acera Insurance offers comprehensive coverage for these insurances. Click here for a quote. 

    2. Recommendations include, but are not limited to:

      1. Cancellations Insurance

      2. Trip Interruption Insurance

      3. Evacuation Insurance

      4. Medical Insurance

  7. Age Requirements and Skiing with Minors.

    1. NEHS requires that guests are a minimum of 19 years or older to travel and ski on their own..

    2. Guests between the ages of 16 and 18 years of age (minor) may book but must be accompanied by a Parent or Legal Guardian at all times while skiing/riding.

      1. Release of Liability for the minor must be signed by the Parent or Legal Guardian that will be skiing with them. It is the Parent/Legal Guardian’s responsibility to review the risk, dangers and hazards with the minor prior to the trip.

      2. Minors must have a current working email address to access the skier portal to input their personal information and preferences. The parent or guardian can assist them with this process.

      3. All minors must be strong, competent intermediate to advanced level skiers or boarders with prior experience in powder and back-country conditions preferred. NEHS is not responsible for the supervision of minors.

    3. Guests younger than 16 years of age may be considered when booking a Private package with NEHS. Please contact our office to discuss this option further. 

  8. Vertical Guarantees/Refunds.

    1. Yellow Cedar Lodge and Mountain Lodge Packages

      1. Unlimited Vertical is Included. There are no additional charges for vertical. 

      2. Your vertical each day, whether by Heli or by Snowcat back-up, is cumulative and will be posted for you to keep track of.

      3. Due to Helicopter start costs, NEH records a minimum run vertical of 1,500 vertical feet (450m).

      4. There are no refunds for unskied vertical when a guest chooses not to participate (departs late or comes in early), arrives late or departs early, sits out runs, or due to physical fitness, ability, sickness or injury. 

      5. If, due to poor weather or mechanical breakdown only, you are unable to ski/board the minimum guaranteed vertical in your package (see table below), you will be refunded at $152 per 1,000m ($46 per 1,000 feet) for the unskied/boarded portion.

    2. Private Packages 

      1. Unlimited Vertical is Included. There are no additional charges for vertical. 

      2. If, due to poor weather or mechanical breakdown only, you are unable to fly the minimum guaranteed flight time (see table below), you will be refunded at $215 per 0.1hr of unused flight time.

    3. Extreme Events

      1. In rare circumstances, events beyond our control, such as extreme weather, may make skiing/riding impossible or unsafe and we may be unable to ski or ride for a significant portion of your package. In these rare cases we will offer you a Rebooking Incentive to be combined with your Vertical Refund as a Rebooking Credit toward a future NEHS trip as follows:

        1. If you ski less than 65%, but more than 30%, of your guaranteed vertical, you will receive a Rebooking Incentive of 15% of your package cost plus the calculated vertical refund as a Rebooking Credit.

          • Both the Rebooking Incentive plus your Vertical Refund must be left on account as the Rebooking Credit and used together towards a future NEHS trip.

          • Rebooking Credits are valid for 2 years, have no cash value and are non-transferable.  

        2. If you ski less than 30%, of your guaranteed vertical, you will receive a Rebooking Incentive of 25% of your package cost plus the calculated vertical refund as a Rebooking Credit.

          1. Both the Rebooking Incentive plus your Vertical Refund must be left on account as the Rebooking Credit and used together towards a future NEHS trip.

          2. Rebooking Credits are valid for 2 years, have no cash value and are non-transferable.

  9. Drugs and Alcohol: Participating in activities organized by NEHS while under the influence of drugs or alcohol is strictly prohibited. You acknowledge and agree that whenever participating in an activity organized by NEHS, you and the members of your party will not be impaired by or use any substance, including, but not limited to, alcohol, cannabis, illegal drugs and other controlled substances. We reserve the right to deny participation by anyone that appears to be in contravention of this policy. This includes helicopter transfers.

  10. Respectful Behaviour: We are committed to providing a welcoming, safe and respectful environment for all guests and staff. Any form of violence or harassment will not be tolerated and may result in immediate termination of services and expulsion from the premises/trip without refund or compensation at guest’s expense.

  11. Governing Law & Jurisdiction. The trip booking and all disputes relating to or arising out of the booking and these T&Cs, and any injury, loss or damage suffered by a guest while participating in a booking, are governed by and will be interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction and any litigation shall be brought solely within British Columbia and shall be within the exclusive jurisdiction of the Courts of British Columbia.
